In recent years, Cheng Guangxin has handled a number of innocent defense cases. “Keep moving, you're still young, you can be anything you want to be.” This is a sentence that lawyer Cheng Guangxin gave himself when he was 30 years old. 02. “Shoulder the mission, with the power of law to help the fate of others”

“It's not a case, it's someone else's life.” This is the most heart-wrenching line in the movie “Article 20.” For lawyers, once they accept the entrustment of the client, they shoulder the heavy responsibility of safeguarding the legitimate rights and interests of the client and must go all out. “Zhang Yuhuan case” is the first public interest appeal case that lawyer Cheng Guangxin participated in, which is of great significance. The case was assisted by eight lawyers, each of whom initially reviewed the case independently and made their own opinions, eventually reaching a consensus that it was a “not guilty case.”

In the follow-up investigation and evidence collection, they tried their best, despite all the difficulties, they still insisted. Fortunately, the end result was gratifying, and Zhang Yuhuan finally saw the light after 27 years and 9,778 days of detention. In defense of every common man, faced with the fate of one man, we must proceed with caution and with a reverence for the law. Cheng Guangxin lawyer also lamented: “Before the lawyer took over this case, Zhang Yuhuan never stopped complaining, but almost no substantive progress was made, until Wang Fei lawyer took over, the case turned a corner, which fully explains the importance of lawyers' participation.”

When lawyer Cheng Guangxin handled the case of “Shanghai student Liu providing illegal intrusion into computer information system programs and tools”, he endured tremendous psychological pressure, and this case was also of great significance to him, making him more firm in the direction of criminal defense. Liu is an outstanding student at a university in Shandong Province. Due to his family's financial difficulties, he works and studies to reduce his burden. In an accidental opportunity, Liu Yuan (a pseudonym), a Courier of a large Courier company, took advantage of his duties to collect recipient information and sell it for personal gain. Liu Yuan (a pseudonym) found Liu and lied that he needed to develop a software to improve work efficiency for automatic and batch screening of express bill data. After Liu completed the software development, he received 6,000 yuan in compensation. However, soon after, nearby residents frequently received fraudulent phone calls, the information leak was revealed, and the police investigation found that the Courier station staff leaked the relevant information.

When lawyer Cheng Guangxin took over the case, the investigation stage was over and it was about to be transferred to the procuratorate for review and prosecution. He is well aware that if the problem cannot be solved at the examination and prosecution stage, once the case enters the court stage, the difficulty of defending Liu's innocence will be greatly increased. He must therefore fight for non-prosecution. Through careful review of the case materials, lawyer Cheng Guangxin found that there were major problems with the evidence. Due to his lack of social experience, Liu was deceived by Liu Yuan (a pseudonym) and developed software aimed at improving work efficiency. He did not know Liu Yuan's real intention, nor did he have the subjective intention of committing a crime. Lawyer Cheng Guangxin further consulted computer experts to confirm that the software did not have the function of hacking into computer systems, thus more convinced of Liu's innocence.

In order to achieve non-prosecution, it is essential to obtain a letter of understanding. Although Cheng Guangxin was worried about dealing with the Courier company, he decided to try. In talking with Mr. Han, the network information security engineer of the express company, lawyer Cheng Guangxin unexpectedly found that Mr. Han showed great tolerance and understanding of the case. Mr. Han said that he also had a work-study experience when he was young, and understood that Liu's behavior was not self-willed, so he was willing to issue a letter of understanding.

Although Cheng Guangxin's legal non-prosecution proposal was not adopted, the procuratorate finally made a discretionary decision not to prosecute, which did not affect Liu's future. Later, Liu successfully obtained his undergraduate degree and was admitted to a graduate school in a university in Hainan. The case made Cheng more convinced of the responsibility and mission of defense lawyers, and that a successful defense may save the fate of a person, or even a family.
