1. Payment base of social insurance
After the social pay for 2023 is published, the social security contribution base for the period from July 1, 2024 to June 30, 2025 will be adjusted accordingly. For the employees of the employer, the maximum payment base is 12,307 yuan ×300% = 36921 yuan, and the minimum payment base is 12,307 yuan ×60% = 7,384 yuan.
2. Payment base of housing provident fund
Both employers and workers must contribute to the housing accumulation fund. The upper limit of the housing provident fund contribution base of employees and employers in Shanghai shall be 300% of the average monthly salary of employees in the city in the previous year, and the lower limit shall be the minimum wage of the city in the previous year. The housing provident fund is generally calculated in accordance with the 5%-7% contribution ratio of the employees themselves and the units. The monthly CPF account contribution amount is twice the contribution base.

3. The maximum amount of economic compensation for rescinding or terminating labor contracts
At the time of rescinding or terminating a labor contract, if the monthly wage of a worker is three times higher than the average monthly wage of the employee of the previous year in the area where the employing unit is located, the standard for payment of economic compensation shall be three times the average monthly wage of the employee. After the announcement of Shanghai's social wages in 2023, the standard of workers' monthly wages higher than three times the average monthly wages of employees in the previous year in the region where the employer is raised, and the tripling standard of economic compensation for rescinding or terminating labor contracts is 12,307 yuan ×3 times = 36,921 yuan, an increase of 372 yuan over the previous year.
4. Cancel the tax exemption amount for payment of economic compensation under labor contracts
The one-time compensation income obtained from the termination of the labor relationship between an individual and an employing unit may be exempted from individual income tax within a certain amount. The part of the compensation income within 3 times the local average salary of the employee in the previous year shall be exempt from individual income tax; The part of the amount exceeding three times shall not be incorporated into the comprehensive income of the current year, and the comprehensive income tax rate table shall be applied separately for tax calculation.
According to this, after the announcement of Shanghai's social wage in 2023, the personal income tax exemption for one-time economic compensation obtained by individuals due to the dissolution of labor relations is 12,307 yuan ×3×12 months = 443,052 yuan.
5. Sick pay standard
The Notice of Shanghai Municipality on Strengthening the Management of Illness Leave for Enterprise Employees and Ensuring the life of employees during illness Leave stipulates that if an employee is on continuous leave for illness or non-work-related injury for less than 6 months, the employer shall pay 60% to 100% sick pay according to the continuous working years of the employee and according to the calculation base. If the monthly wage of a laborer is higher than the average monthly wage of the previous year in Shanghai, the employing unit may calculate and pay sick pay according to the average monthly wage of the previous year in Shanghai.
After the announcement of Shanghai's social pay in 2023, if the worker takes a continuous leave for less than 6 months due to illness or non-work-related injury, and the monthly wage is higher than the average monthly wage of Shanghai in 2023, the employer may calculate and pay sick pay according to the social pay in 2023 of 12,307 yuan. However, this provision is not mandatory, the employer's current sick pay calculation method is higher than this provision, according to the employer's calculation method.
6. Maternity allowance standards
Maternity allowance for female workers during maternity leave, for those who have participated in maternity insurance, shall be paid from the maternity insurance fund according to the average monthly wages of the employees of the employing unit in the previous year; For those who do not participate in maternity insurance, the employer shall pay them according to the standard of the wages of female employees before maternity leave. If the average monthly wage of the employee of the employing unit to which the female worker works at the time of childbirth or abortion is higher than 300% of the average monthly wage of the employee of the whole city in the previous year, the salary shall be calculated at 300%; If it exceeds 300%, the excess part shall be made up by the employer; If the salary is less than 60% of the average monthly salary of the city's employees in the previous year, the salary shall be calculated at 60%.

7. Standard for one-off industrial injury medical benefits

According to the relevant provisions of the Measures of Shanghai Municipality on industrial injury insurance, those who meet the conditions for receiving one-off industrial injury medical benefits shall be paid according to the average monthly wages of the employees of the city in the last year when they terminate or terminate their labor relations, and shall be paid by the industrial injury insurance fund.

The funeral subsidy payment standard is the average monthly salary of the employees in the previous year of the overall planning area for 6 months. 10. The social wage standard in Shanghai where the labor contract is performed
According to the relevant provisions of the Regulations on the Implementation of the Labor Contract Law, if the place of performance of a labor contract is inconsistent with the place of registration of the employing unit, the minimum wage standard, labor protection, working conditions, occupational hazard protection and the average monthly wage standard of the employees in the previous year and other matters related to the workers shall be implemented in accordance with the relevant provisions of the place of performance of the labor contract. Where the relevant standards at the place where the employer is registered are higher than those at the place where the labor contract is performed, and the employer and the worker have agreed to comply with the relevant provisions at the place where the employer is registered, such agreement shall prevail.
According to the above provisions, in the absence of a clear agreement between the worker and the employer, when the employer is registered in another country and the labor contract is performed in Shanghai, the relevant amount shall be determined using the social wage as the base, and the social wage of Shanghai in 2023 shall be calculated on the basis of Shanghai's social wage of 12,307 yuan.
