27. In the case where the victim Su was intentionally harmed and died by multiple people, he served as a proxy lawyer and was supported by a change of charges, bringing the offender to justice.
This case is a major "accidental fall and death" case in a certain city. The public security organs have filed an investigation on the crime of "provocation and disturbance". After accepting the commission of the victim's family to intervene in the case, I have serious objections to the characterization of the involved behavior and proposed that it should be transferred to the procuratorate on the crime of "intentional injury (causing death)". I have submitted written legal opinions multiple times, but the public security organs insist on not changing the investigation charge. After being transferred to the prosecutor's office for review and prosecution, I continued to communicate and exchange ideas with the handling prosecutor and the chief prosecutor in charge regarding the erroneous charges involved in the case. Eventually, the prosecution changed the charges when filing a public prosecution with the court, and filed a prosecution for the crime of illegal detention (causing death). During the trial phase, I continued to communicate and exchange legal opinions with the presiding judge regarding the issue of incorrect charges, and wrote legal opinions multiple times. I also provided legal opinions on the qualitative issues of this case during the trial. In the end, the people's court adopted our opinion and sentenced the six defendants to death for the crime of intentional injury. After the verdict was pronounced, the defendants appealed to the second instance people's court to change the verdict on the crime of provocation and disturbance, and the second instance court ultimately upheld the original verdict. In the trial stage of this case, I also assisted the victim's family in communicating and negotiating with the defendant's family, and helped the deceased's family obtain hundreds of thousands of yuan in economic compensation in accordance with the law.
The significance of this case lies in directly breaking the stereotype that "the lawyer representing the victim in criminal proceedings is just a decoration and cannot play any role", fully proving that as long as the criminal lawyer carries out his work in accordance with reason, law, and seriousness, even if he represents the victim, he can still play the value of litigation, maintain the correct implementation of the law, and safeguard the legitimate rights and interests of the parties involved.
28. In the case of Chen's intentional injury, he acted as a proxy lawyer and brought the criminal to justice.
In this case, the criminal assaulted the victim in front of law enforcement officers, causing minor injuries to the victim. But after the incident, the public security organs did not file a criminal case. After accepting the commission of the victim's family to intervene in the case, we communicated with the public security organs at the legal level and filed a case supervision with the People's Procuratorate, ultimately obtaining a criminal case. But after the case was filed, the public security organs began to delay the investigation time without reasonable reasons, and did not transfer it to the procuratorial organs for review and prosecution. Through our six months of running, complaining, and submitting opinions, we ultimately punished the perpetrator and allowed the victim to receive economic compensation.
29. Served as a defense counsel for Cheng's intentional homicide case and received a lighter sentence.
This case is a highly influential intentional homicide case in the local area. Cheng, a well-known master's student from a university, has performed well since childhood and achieved excellent results. Later, due to careless socializing, he led to excessive consumption and huge loan debts, ultimately intensifying conflicts. He passionately killed his friend at home, using extremely cruel methods, resulting in one death and one minor injury. The trial personnel in this case have a high standard, with the presiding judge being the President of the Municipal Intermediate People's Court and the prosecutor being the Procurator General of the Municipal People's Procuratorate. By providing professional defense opinions and repeatedly pleading guilty and negotiating, he was ultimately sentenced to 15 years in prison.
